Overview

This workshop covers an overview of all the key pieces of legislation an operational manager needs to know about employee rights.

Topics include:

  • All equal opportunities/discrimination legislation since 1974
  • The family friendly rights introduced as part of the Employment Rights Act 1996 and the Employment Act 2002.
  • Disciplinary and grievance procedures.
  • The Data Protection Act 1998.

At the heart of the workshop are the fundamentals of an employment contract and the rights of both parties. It also focuses on the daily actions (they may be quite innocent) that managers can do that may breach employee rights or the employment contract, or create contractual terms through working practices. The module will be a mixture of factual law, looking at real life case studies, discussion of delegates own experiences

  • Understand the different types of contractual terms and contracts

  • Identify and prevent working practices that could lead to contractual terms through custom and practice.

  • Understand how to legally change terms and conditions of employment.

  • The legislative requirements and content of contracts of employment

  • Changing contracts of employments and the business case

  • Part-time and Fixed Term Workers

  • Equal Pay, Sex/Race/Disability/Religious/ Gender Orientation/Age discrimination- this will also include bullying and harassment

  • Statutory rights regarding domestic incidents, parental leave, maternity leave, paternity leave, adoption leave, right to request flexible working

  • The purpose and requirements of the Data Protection Act

  • Disciplinary and Grievance procedures

  • Compensation limits and compensation awards made by the courts
